Adult Waiver and Release
In consideration of my entry being
accepted, I intend to be legally bound, and do hereby, for myself, my heirs,
executors, waive and release all rights and claims for damages which may have
or which may hereinafter accrue to me against Track Shack of Orlando, LLC (TS),
Track Shack Fitness Club (TSFC) Event
Marketing and Management Int’l., LLC, (EMMI), RRCA, all city entities, sponsors, venues, and
vendors of the event which I am entering, any subsidiary or political
division thereof, of their respective officers, agents, directors,
representatives, successors, assigns, and sponsors for any and all damages or
injuries which may be sustained and suffered by me in connection with my
association with entry or participation in this event as is mentioned
above. If I should suffer injury or illness, I authorize officials of the
race to use their discretion to have me transported to a medical facility, and
I take full responsibility for this action. I attest and certify that I am
physically fit and have sufficiently trained for the completion of this
event. I hereby grant full permission to any and all of the
foregoing to use any photographs, videotapes, motion pictures, recordings or
any other record of this event for any purpose. I
voluntarily agree to assume all of the foregoing risks and accept sole
responsibility for any injury to myself (including, but not limited to,
personal injury, disability, and death), illness, damage, loss, claim,
liability, or expense, of any kind, before, during and after this event I hereby release, covenant not to sue, discharge, and hold
harmless TS, TSFC, EMMI its employees, agents, and representatives, of and from
the Claims, including all liabilities, claims, actions, damages, costs or
expenses of any kind arising out of or relating thereto. I understand and agree
that this includes any Claims based on the actions, omissions, or negligence of
TS, TSFC, EMMI its employees, agents, and representatives. Baby carriers, backpacks, skates, scooters, bicycles, skateboards, and animals of any kind are prohibited. The use of headphones
is discouraged. I HAVE READ THE ABOVE RELEASE AND UNDERSTAND THAT
I AM ENTERING THIS EVENT AT MY OWN RISK.

NOTICE TO THE MINOR CHILD’S NATURAL GUARDIAN
READ THIS FORM COMPLETELY AND CAREFULLY. YOU ARE AGREEING TO LET YOUR MINOR CHILD ENGAGE IN A POTENTIALLY DANGEROUS ACTIVITY. YOU ARE AGREEING THAT, EVEN IF THE RELEASEES (AS DEFINED ABOVE) USE REASONABLE CARE IN PROVIDING THIS ACTIVITY, THERE IS A CHANCE YOUR CHILD MAY BE SERIOUSLY INJURED OR KILLED BY PARTICIPATING IN THIS ACTIVITY BECAUSE THERE ARE CERTAIN DANGERS INHERENT IN THE ACTIVITY WHICH CANNOT BE AVOIDED OR ELIMINATED. BY SIGNING THIS FORM YOU ARE GIVING UP YOUR CHILD’S RIGHT AND YOUR RIGHT TO RECOVER FROM THE RELEASEES IN A LAWSUIT FOR ANY PERSONAL INJURY, INCLUDING DEATH, TO YOUR CHILD OR ANY PROPERTY DAMAGE THAT RESULTS FROM THE RISKS THAT ARE A NATURAL PART OF THE ACTIVITY. YOU HAVE THE RIGHT TO REFUSE TO SIGN THIS FORM, AND THE RELEASEES HAVE THE RIGHT TO REFUSE TO LET YOUR CHILD PARTICIPATE IF YOU DO NOT SIGN THIS FORM.
